Welcome to CertifiedKhaos.com (“Certified Khaos,” “we,” “us,” or “our”). By accessing or using our website and services (collectively, the “Khaos Services”), you agree to comply with and be bound by these Terms of Use. If you do not agree with these terms, please do not use the Khaos Services.
1. Description of the Khaos Services
These Terms of Use describe the terms and conditions that govern your use of the “Khaos Services” (defined below) and constitute a legally binding agreement between you and the entity providing you with access to the particular Khaos Service.

If you submit any content to the Khaos Services, you grant Certified Khaos a worldwide, royalty-free, sublicensable, and transferable license to use, display, and distribute such content in connection with the Khaos Services. You represent and warrant that you have all necessary rights to grant this license.
7. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Interfering with or disrupting the Khaos Services or servers.

Certified Khaos reserves the right to suspend or terminate your access to the Khaos Services at its sole discretion, without notice, for conduct that violates these Terms of Use or is harmful to other users or to Certified Khaos
9. Disclaimers and Limitation of Liability
The Khaos Services are provided “as is” and “as available.” Certified Khaos makes no representations or warranties of any kind, express or implied, regarding the operation of the Khaos Services or the information, content, or materials included therein.
To the fullest extent permitted by applicable law, Certified Khaosshall not be liable for any damages arising out of or in connection with your use of the Khaos Services.
10. Indemnification
You agree to indemnify and hold harmless Certified Khaos, its affiliates, and their respective directors, officers, employees, and agents from any claims, losses, liabilities, and expenses arising out of your use of the Khaos Services or violation of these Terms of Use.
11. Governing Law and Dispute Resolution
These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Check below section 14 for more information.
12. Changes to Terms
Certified Khaos reserves the right to modify these Terms of Use at any time. Any changes will be posted on this page with an updated effective date. Your continued use of the Khaos Services after such changes constitutes your acceptance of the new terms.

14. Arbitration Agreement
14.1 Binding Arbitration: Except for claims that may be resolved in small claims court or where otherwise prohibited by law, you and Khaos Sports agree that any dispute, claim, or controversy arising out of or relating to these Terms of Use, your use of the Khaos Services, or any products or services offered by Khaos Sports, shall be resolved exclusively through binding arbitration, rather than in court.
14.2 Arbitration Rules and Location: Arbitration will be conducted by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration shall take place in [San Diego, California] or another mutually agreed-upon location. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.
14.3 No Class Actions or Representative Claims: You and Khaos Sports agree that arbitration shall be conducted on an individual basis only. You may not bring any claims as a class, collective, or representative action, nor participate in a class, collective, or representative action brought by others.
14.4 Fees and Costs: Each party shall bear its own costs and attorney’s fees, except as otherwise provided by law or the AAA rules. Khaos Sports will reimburse any filing fee charged by the AAA if you cannot afford it.
14.5 Opt-Out: You have the right to opt-out of this arbitration agreement by sending written notice to Khaos Sports at support@khaossports.com within 30 days of first agreeing to these Terms of Use. Your notice must include your name, address, email, and a statement that you do not wish to resolve disputes through arbitration. Opting out will not affect the rest of the Terms of Use.
14.6 Exceptions: This arbitration agreement does not prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction where necessary to protect intellectual property or confidential information.
